Tariff Update: Appeals Court Grants Stay on CIT Ruling

Last week’s ruling by the U.S. Court of International Trade threatened to roll back the Trump-era “Liberation Day” tariffs on imports from China, Canada, Mexico, and other key trade partners. The court found that the administration had overstepped its authority under the International Emergency Economic Powers Act (IEEPA), a statute typically reserved for national security emergencies.

However, as of May 29, a federal appeals court has granted a stay, keeping those tariffs in effect during the appeal process.

For shippers and importers, this means ongoing tariff exposure and continued uncertainty around pricing, supply chain strategy, and long-term contract planning. While the legal outcome remains in flux, businesses may need to brace for months of volatility.

Now is the time to review sourcing, reevaluate risk, and stay agile.
